USE OF EQUIPMENT
All Equipment supplied by the Company during the Booking is owned by the Company, however, the Customer and its guests agree to use the Equipment at their sole risk. The Customer and its guests release, to the full extent permitted by law, the Company and its officers, agents, employees and contractors from all claims of every kind resulting from any accident, damage or injury caused by the use of the Equipment.
The Customer acknowledges and agrees that it is responsible for the security of the Equipment until it is collected by the Company. The Equipment must be returned to the Company in the same good working order and condition as when set-up.
The Customer agrees that it will never leave the picnic site or the Equipment unattended during the Booking time.
The Customer acknowledges and agrees that it must pay for any Equipment damage or loss caused during the Booking period. “Damage or loss” includes, but is not limited to:
· disappearance, loss or theft of any Equipment, including cutlery, glassware and décor items;
· red wine or other stain-inducing spillages or other stains on any Equipment, furniture or décor item;
· cigarette burns on any piece of Equipment, furniture or décor items.
*Note that smoking is not permitted while using the Company’s Equipment.
In the event of theft of any Equipment, the Customer must notify the Company in writing and provide a full statement of the circumstances of the theft and provide a police report number.
RETRIEVAL OF EQUIPMENT
In the event of abandonment of the Equipment and/or any breach of these Ts & Cs by the Customer, the Customer agrees and authorises Bubbly Grazey to enter any premises or location at which the event is being held to retrieve its Equipment. The Customer indemnifies and holds Bubbly Grazey harmless from any and all liability, costs, damages, claims, demands and proceedings, howsoever arising, from such retrieval. The Customer agrees to reimburse Bubbly Grazey for any liability, costs, damages, claims, demands and proceedings, howsoever incurred, in exercising this right.
In the event the Customer is more than one person, their liability under these Ts & Cs is joint and several.
UNSUITABLE WEATHER
If the picnic event is to be held outside (especially during the colder months), it is the responsibility of the Customer to organise an alternate plan or location for the event. This change must be made at least 3 hours’ in advance to the commencement of the event.
SOCIAL MEDIA & ADVERTISING
The Customer agrees the Company has the right to take photos at each Booking for its own promotional/ social media purposes. Where the Customer or guests are involved, the Company’s staff will seek permission in advance to take a photo. If permission is not granted, the photo will not be taken.
JURISDICTION
These Ts & Cs are governed by the law applicable in Western Australia. The Customer and the Company irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Western Australia.
